Martin F. Majestic’s intellectual-property law experience spans more than three decades. The breadth of  his practice includes patent, trademark, and copyright prosecution, litigation, and counseling. Following his role as a medical-device arts patent examiner in the U.S. Patent and Trademark Office, Martin practiced with several intellectual-property firms in San Francisco, including Phillips, Moore, Weissenberger, Lempio & Majestic. He later co-founded a second firm titled Majestic, Parsons, Siebert & Hsue in 1982. Prior to law school, he was a research engineer for an aerospace company.


Martin’s federal-court experience includes litigating patent, trademark, copyright and related unfair competition cases, including appeals to the U.S. Court of  Appeals for the Federal Circuit and the Ninth Circuit. This includes enforcement of intellectual-property rights against counterfeit products.


Martin has served as both a consultant and an expert witness in patent litigation and has served as a court appointed special master in a trade secrets case. Martin was a court appointed neutral evaluator and mediator in a number of  patent, trademark and copyright cases for the U.S. District Court for the Northern District of California for more than 10 years. This is the same court for which he served as an arbitrator on a three-member panel that decided a wide range of  cases.

Helping clients build, license and enforce worldwide intellectual property portfolios has been a major portion of  Martin’s practice. He has prepared and prosecuted patent applications to patent issuance and prepared numerous trademark applications to registration before the U.S. Patent and Trademark Office, including appeals, reissues, reexaminations, trademark oppositions, trademark cancellations and concurrent use proceedings. Martin negotiates and drafts agreements involving licensing of intellectual-property rights, prepares patent-infringement and validity opinions and works on the intellectual-property due-diligence aspects of mergers and acquisitions.
